Have an investor pitch or product launch coming up?
Your Next Business Milestone Could Be Your Patent Filing Deadline.
Investor presentations, product demonstrations, conference submissions, and launch announcements can involve disclosures of potentially patentable technical information. The consequences depend on the jurisdiction, disclosure circumstances, and applicable law — not every investor conversation is a public disclosure, and confidentiality arrangements matter.
Before sharing technical details publicly, discuss your invention and filing strategy with Hashi IP Solutions.
Before Fundraising
Prepare for investor discussions involving technical details of your innovation.
Before Public Disclosure
Assess filing options before presentations, publications, exhibitions, or public demos.
Before Product Launch
Coordinate patent documentation with commercialization timelines.
Before Licensing Discussions
Evaluate how to document and file the invention before sharing sensitive technical information.
What we deliver
Provisional Patent Filing Services We Provide.
Each engagement is scoped to the invention and jurisdiction; not every service is included in every engagement.
Provisional Patent Application Preparation
Structure the invention disclosure into a filing-ready provisional document aligned to the intended jurisdiction.
Invention Disclosure Structuring
Turn prototypes, notes, code descriptions and diagrams into an organized technical narrative.
Embodiment and Alternative Capture
Work with inventors to identify essential features, alternatives, variations, components, and implementation details.
Technical Drawings and Figures
Coordinate supporting system diagrams, flowcharts, schematics, and technical illustrations where appropriate.
US Provisional Application Support
Assist with preparation and filing coordination for an appropriate US provisional application, including follow-on nonprovisional requirements.
Indian Provisional Specification Filing
Support preparation of an Indian provisional specification and related filing documentation, where appropriate under Indian patent law.
International Filing Strategy
Assess intended markets and possible national, regional, convention, or PCT routes. A US provisional or Indian provisional specification does not itself provide worldwide protection.
Follow-On Patent Application Planning
Identify the applicable follow-on deadline and plan the transition to a complete or nonprovisional application, as appropriate.
Disclosure quality
A Strong Patent Filing Starts With a Complete Technical Disclosure.
A filing date alone is not enough. The disclosure must adequately describe the invention and support the subject matter for which an earlier priority date will later be claimed. A rushed or skeletal submission can leave important features without the required support.

Don't File a Skeleton Disclosure. Document the Invention You Intend to Protect.
Claims are not required in a US provisional application, but a sufficiently detailed written description and necessary drawings are important. In India, a provisional specification has its own statutory requirements. A filed provisional cannot be freely amended to add new matter — new technical matter may require a later filing and may receive a later priority date.
Filing before fundraising
Planning to Raise Capital? Address Patent Filing Before the Pitch.
A startup's intellectual property can form part of its technology story, product differentiation, and investor due diligence. Before pitching a potentially patentable invention, founders should assess whether filing is appropriate and whether the technical disclosure is sufficiently developed. Filing does not guarantee funding, valuation, or competitive advantage.
- Organize technical invention details before investor presentations.
- Prepare an appropriate patent disclosure.
- Assess suitable initial filing routes.
- Coordinate filing with fundraising and product development milestones.
- Identify follow-on filing requirements.
- Plan IP documentation for future commercial discussions.

Filing before public disclosure
Planning to Publish, Demonstrate or Launch? Review Patent Filing First.
Public disclosure may affect patent rights differently across jurisdictions. Some provide limited exceptions or grace periods, while others apply stricter novelty requirements. A disclosure treated one way under US law can still create significant risks in other markets. The effect of a provisional filing depends on its disclosure, dates, jurisdiction, and later claims.
The best time to evaluate a filing strategy is before the disclosure — not after the opportunity has been lost.
We help innovators assess filing options before:
- Publishing a paper or preprint
- Presenting at a conference
- Demonstrating a prototype publicly
- Launching a product
- Publishing technical videos or blogs
- Entering an exhibition or innovation competition
- Announcing an invention to the market
Self-prior-art and disclosure risk
Reduce Disclosure Risk With a Timely, Well-Supported Filing Strategy.
When an inventor publishes or publicly discloses an invention before filing, that disclosure may affect the availability of patent protection. The impact varies by country, timing, disclosure circumstances, and applicable exceptions. A properly prepared and timely filing can help establish an earlier filing or priority date for adequately disclosed subject matter, subject to applicable legal requirements.
Establish an Earlier Filing Position
Document the invention before relevant disclosure events where an appropriate filing route is available.
Support Subsequent Patent Claims
A later application may obtain the benefit of an earlier filing date only for subject matter that meets the applicable support and priority requirements.
Coordinate Filing With Commercial Milestones
Align patent documentation with investor pitches, product demonstrations, publication plans, and launch schedules.
A filing does not automatically protect undisclosed improvements or guarantee that every later claim receives the earlier date. Prior disclosures may already have affected patentability, and a filing in one jurisdiction does not automatically establish rights in every country.
India · United States · International routes
Provisional Patent Filing Support for Your Target Markets.
A US-style provisional application is not available in every country. We identify the relevant jurisdiction and recommend the appropriate route.
India — Provisional Specification Filing
Developing an invention in India? We help assess and prepare an Indian patent application accompanied by a provisional specification where appropriate — including disclosure development, specification preparation, filing coordination, and planning for the complete specification.
Under Section 9 of the Indian Patents Act, a complete specification generally must be filed within 12 months of the provisional filing date. The disclosure and later claims must meet applicable legal requirements to obtain the intended benefit.

Preparing for a US investor pitch, product launch, or market entry? We support preparation and filing coordination for US provisional patent applications, subject to the agreed scope and applicable requirements.
A US provisional application is not substantively examined and does not itself become a granted patent. A corresponding nonprovisional application generally must be filed within 12 months, and later claims must be supported by the provisional disclosure to obtain its filing date.
Official source: USPTO provisional application guidanceOther Countries — International Filing Strategy
Planning to commercialize in Europe, the UK, Australia, Japan, China, or other markets? Some countries do not provide the same type of provisional route available in the US or India. We help assess initial filing choices, priority strategy, convention filings, and potential PCT or national-phase routes.
A PCT application is an international application route, not a worldwide patent grant. The appropriate route depends on the target jurisdictions.

Provisional Patent Filing FAQs
Can I file a provisional patent application before pitching to investors?
Often, yes. Where an appropriate route exists — such as a US provisional application or an Indian provisional specification — filing before an investor pitch can establish an earlier filing position for adequately disclosed subject matter. Whether a particular pitch is a public disclosure depends on confidentiality arrangements and circumstances.
Should I file a patent application before a startup demo day?
Demo days are frequently public. If you plan to show potentially patentable technical details, discuss filing options beforehand so the disclosure and timeline can be assessed for your target jurisdictions.
Can I file before publishing a research paper or presenting at a conference?
Yes, filing before publication is generally advisable where patent protection is being considered. University inventors should also consider institutional ownership and technology-transfer policies.
Can a provisional application help protect an invention before product launch?
A timely, well-supported filing can establish an earlier filing date for the subject matter it adequately describes. It does not itself grant enforceable rights, and later claims must be supported by the disclosure.
What should a provisional patent disclosure contain?
A detailed description of the invention, how it operates, its components, embodiments and alternatives, and the drawings needed to understand it. Indian provisional specifications have their own statutory requirements; the documentation should be tailored to the jurisdiction.
Can an incomplete provisional disclosure create problems for later patent claims?
Yes. A later application may claim the earlier date only for subject matter adequately supported by the earlier disclosure. New matter generally cannot be added to a filed provisional and may require a new filing with a later date.
Can a provisional application help reduce self-prior-art risks?
Filing before your own disclosure can reduce the risk that the disclosure becomes prior art against adequately supported subject matter. It cannot remove the effect of disclosures made before filing, and the outcome depends on dates, jurisdiction and later claims.
What is the difference between an Indian provisional specification and a US provisional patent application?
Both are early filings followed by a later complete or nonprovisional application, generally within 12 months. They are governed by different statutes, forms and requirements — for example, US provisional applications do not require claims, while India's provisional specification is filed with an application under the Patents Act.
Can I file a provisional patent application in India?
Yes. Indian law allows an application to be accompanied by a provisional specification, with a complete specification generally due within 12 months of filing under Section 9 of the Patents Act.
How long do I have to file the next application in India or the US?
Generally 12 months from the provisional filing date in both India (complete specification) and the US (nonprovisional application). Specific deadlines should be confirmed for each matter.
Can a US provisional application protect my invention in India or Europe?
Not by itself. It can serve as a priority basis for later convention or PCT filings within the applicable period, but protection requires filings in the relevant jurisdictions.
What if I have already disclosed my invention publicly?
Contact us promptly for a case-specific review. Some jurisdictions offer limited grace periods while others apply strict novelty, so the effect depends on what was disclosed, when, where and how.
Can I file a provisional application if my prototype is not complete?
A working prototype is not always required, but the disclosure must describe the invention in sufficient technical detail. Features not yet conceived or described will not be supported by the filing.
What documents should I provide to start?
Begin with a brief non-confidential summary, your target markets and milestone dates. Detailed technical materials — drawings, notes, test data — are shared after an NDA and a secure sharing process are agreed.
How much does provisional patent application preparation and filing cost?
Scope, professional fees and official fees depend on the invention, jurisdiction and required documentation. Share your requirements and we will discuss an appropriate scope and quotation.
Can Hashi IP Solutions help plan filings in multiple countries?
Yes. We help assess priority strategy, convention filings, PCT and national-phase routes based on your target markets and timeline, coordinating with local associates where required.
